Terms & Conditions

Last Updated: November 3, 2026

These Terms & Conditions (the "Terms") govern your use of the website at novelity.com and the Novelity web application, crew app and related services (together, the "Services") provided by Novelity Inc, a Nevada corporation ("Novelity," "we," "us" or "our"). By using the Services you agree to these Terms and to our Privacy Policy. If you use the Services on behalf of a company, you agree to these Terms for that company. If you do not agree, do not use the Services.

1. THE SERVICES

Novelity provides fleet management software for trucking companies, including dispatch, scheduling, timecards, telematics integrations and driver messaging. Features available to you depend on your company's subscription and your role. The specific commercial terms for a company's subscription, such as fees and service levels, are set out in its order form or agreement with Novelity, which prevails over these Terms where they conflict.

2. ACCOUNTS

You must give accurate information, keep your sign-in details and one-time codes confidential, and tell us promptly at support@novelity.com if you believe your account has been used without permission. You are responsible for activity under your account. Company administrators are responsible for the users they invite and the roles they assign.

3. ACCEPTABLE USE

You agree not to:

  • use the Services in violation of any law, including laws on telemarketing, text messaging and privacy;
  • send messages through the Services to anyone who has not agreed to receive them, or after they have opted out;
  • send marketing, promotional or unlawful content through the driver messaging features;
  • attempt to access data or accounts you are not authorized to access, or interfere with the security or operation of the Services;
  • copy, resell, reverse engineer or build a competing product from the Services, except where the law allows it.

4. YOUR DATA

Your company owns the data it puts into the Services. You give Novelity permission to host, process and display that data only to provide, secure and improve the Services and as described in our Privacy Policy. Companies that use driver messaging are responsible for obtaining their drivers' agreement before recording it in Novelity.

5. TEXT MESSAGING TERMS (SMS)

Program name: Novelity Driver Messaging.

Program description: Novelity Inc sends operational text messages to truck drivers of the trucking companies that use Novelity, on behalf of their dispatch teams. Messages include run and load offers, schedule changes, terminal instructions, weather and safety notices, clock-out reminders, replies from dispatch to driver questions, and one-time sign-in codes for the Novelity crew app. We do not send marketing or promotional messages.

How you opt in: when you give your company's dispatch your mobile number and agree, on the onboarding form or verbally, to receive dispatch texts, dispatch records your agreement in Novelity. Novelity then sends you one text asking you to confirm. You are subscribed only after you reply YES. Sign-in codes are sent only when you request one in the crew app. Texting is optional: drivers who do not opt in can receive the same messages in the Novelity crew app or by phone from dispatch.

Message frequency: message frequency varies with your work schedule and dispatch activity.

Costs: Message and data rates may apply. Novelity does not charge you for texts; your mobile carrier's rates apply.

Opting out: you can cancel at any time. Reply STOP to any message (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). We will send one message confirming that you are unsubscribed, and you will receive no more texts unless you opt in again. To opt in again, reply START.

Help: reply HELP to any message, or email support@novelity.com. You can also contact your company's dispatch.

Carriers: mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your mobile carrier and is not guaranteed.

Privacy: your mobile number and consent are handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

6. THIRD-PARTY SERVICES

The Services connect to services we do not control, such as electronic logging device and telematics providers, mapping services and mobile carriers. Your use of those services is governed by their own terms, and we are not responsible for them.

7. INTELLECTUAL PROPERTY

Novelity and its licensors own the Services, including the software, design and trademarks. These Terms give you a limited, non-exclusive, non-transferable right to use the Services while your company's subscription is active. Feedback you send us may be used without obligation to you.

8. SAFETY

Do not read or reply to messages, or use the Services, while driving. Pull over safely first. Information in the Services, such as schedules, locations and hours-of-service data, supports but does not replace your own judgment and your legal obligations as a driver or motor carrier.

9. DISCLAIMERS

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT PERMITTED BY LAW, NOVELITY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES OR ANY MESSAGE WILL BE UNINTERRUPTED, TIMELY OR ERROR-FREE.

10. LIMITATION OF LIABILITY

TO THE EXTENT PERMITTED BY LAW, NOVELITY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA. NOVELITY'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE AMOUNTS PAID TO NOVELITY FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS IF NOTHING WAS PAID.

11. SUSPENSION AND TERMINATION

We may suspend or end access to the Services if you breach these Terms, if required by law, or to protect the Services or other users. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.

12. GOVERNING LAW

These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict of laws rules. The state and federal courts located in Clark County, Nevada have exclusive jurisdiction over any dispute relating to these Terms, unless your company's agreement with Novelity says otherwise.

13. CHANGES TO THESE TERMS

We may update these Terms from time to time. We will change the "Last Updated" date above and, for material changes, give notice on our website or in the Services. Continuing to use the Services after a change means you accept the updated Terms.
